1. Acceptance of Terms

By accessing or using Hosted Reviews (“the Service”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Hosted Reviews is a software-as-a-service (SaaS) platform that enables local service businesses to send automated SMS review requests to their customers. The Service includes client management, SMS delivery, review tracking, and analytics.

3. Account Registration

To use Hosted Reviews, you must:

Provide accurate and complete registration information
Maintain the security of your account credentials
Be at least 18 years of age
Have the authority to bind the business you represent

4. Acceptable Use

You agree to use Hosted Reviews only for its intended purpose: sending review requests to customers with whom you have an existing business relationship and from whom you have obtained proper consent.

You agree NOT to:

Send messages to individuals who have not consented to receive them
Use the platform for spam, marketing campaigns, or promotional messaging unrelated to review collection
Send messages that are misleading, deceptive, or fraudulent
Violate any applicable laws, including the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, or any state or local regulations
Attempt to circumvent opt-out requests
Share your account credentials with unauthorized parties
Use the platform in any way that could damage, disable, or impair the Service

You are solely responsible for obtaining proper consent from your customers before sending any SMS messages through Hosted Reviews.

Hosted Reviews provides the technology platform. We do not independently verify that you have obtained consent from each recipient. By sending a review request, you represent and warrant that:

You have an existing business relationship with the recipient
The recipient has provided verbal or written consent to receive an SMS from your business
You will immediately honor any opt-out requests

Failure to comply with SMS consent requirements may result in suspension or termination of your account.

6. Pricing & Payment

Subscription plans and pricing are as listed on the Hosted Reviews platform at the time of purchase.
Subscriptions are billed monthly. You may cancel at any time.
No long-term contracts are required.
Refunds are handled on a case-by-case basis.
We reserve the right to change pricing with 30 days’ notice.

7. Limitation of Liability

Hosted Reviews provides the platform “as is” and “as available.”

To the maximum extent permitted by law:

Hosted Reviews is not liable for any damages resulting from a Business Owner’s failure to obtain proper consent before sending messages
Hosted Reviews is not liable for SMS delivery failures caused by carrier issues, incorrect phone numbers, or recipient device settings
Hosted Reviews is not liable for the content of reviews left by End Users on third-party platforms (e.g., Google)
Our total liability for any claim arising from the Service shall not exceed the amount you paid for the Service in the 12 months preceding the claim

8. Indemnification

You agree to indemnify and hold harmless Hosted Reviews, its owners, employees, and affiliates from any claims, damages, or expenses (including legal fees) arising from:

Your use of the Service
Your failure to obtain proper consent from End Users
Your violation of any applicable law or regulation
Any dispute between you and your customers

9. Account Suspension & Termination

We reserve the right to suspend or terminate your account if:

You violate these Terms of Service
We receive complaints about unsolicited messages sent through your account
Your use of the platform poses a legal or compliance risk
You fail to pay subscription fees

10. Intellectual Property

The Hosted Reviews platform, including its design, code, and branding, is the property of Hosted Reviews. You may not copy, modify, distribute, or reverse-engineer any part of the Service.

11. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or through the platform. Continued use of the Service constitutes acceptance of updated Terms.

12. Governing Law

These Terms are governed by the laws of the State of Michigan, without regard to conflict of law principles.
